There’s little success in resolving issues or getting clarity on a situation from a tenant if you have no way of reaching him or her.  We’ve personally seen tenants changing cell phone numbers, emails, and other contact information every year (or even more frequently!).  Having recent contact information on file is critical in advance of any future issues that may need to be resolved.  If your future issue is a conflict issue, you may have a lot of trouble securing updated contact info at that time.  It’s best to get this information while the relationship is positive and tension-free (which hopefully will also remain that way throughout the term!).

You should always check out your rental properties at least once a year if you haven’t been in during the past 12 months.  An annual inspection is a legitimate way to gain entry and make certain the living conditions are relatively clean, safe, and functional.   This form is best used for longer term tenants that you rarely hear from or those whom you suspect of an infraction which you cannot prove.  In the latter case, you may opt for an annual inspection as a pretext for entry.  But remember to actually do an annual/safety inspection as you cannot fraudulently mislead your tenant on the reason for entry.

Always check your local laws governing access and entry into your tenant’s units to ensure your forms and length of notice time comply with local laws.  Ultimately, you are responsible for making sure the rental property is always safe, and habitable.

Why do I need to provide a form allowing my tenant to install _____?  There are a lot of reasons why you want to do this.  First, tenants quickly adjust to their new home and begin to mistaken their rental unit as their ‘owned’ property.  They may begin to replace plumbing fixtures (ie. shower heads, faucets, etc), install shelving, satellite dishes, cabinets, etc.  Sometimes ‘install’ means removing fixtures that came with the rental property (ie. light fixtures, kitchen/bathroom cabinet, door hardware etc.   We usually provide this declaration form at the start of a new tenancy and use the opportunity to explain that they need the landlord to sign off on ANY permanent change to the rental unit.  That way all permitted work has the documentation backing it up.  Anything without a declaration is not sanctioned and may mean liability on the part of the tenant to fix/repair/replace/restore the unauthorized installation.

This form is also good to have on hand in case of requests from 3rd party installers (ie. trades, telephone, cable, satellite service people, etc.) who are often trained to require building owner permission for any installation.

Our commercial application form is similar style to our residential form but of course it is structured and geared for your commercial applicants.  We specialize in residential landlord forms, not commercial.   However, we recognized that many rental properties may be mixed use properties or small shops and restaurants that are a far cry from giant corporate buildings or plazas.  Obviously, if you own large-scale commercial property, this is not the form for you – although the form does include space and instructions for additional partners, directors, owners, and officers to complete their own personal information portion of the application form.  However, if you’re renting a small building with a shop or a restaurant below and an apartment up top or a live/work townhome, or any combination of residential and small-scale commercial, this form will suit you extremely well.

What you decide to do if you recently signed on a tenant who has suddenly changed their mind and no longer wishes to honour the rental agreement is entirely up to you.  However, as a landlord, you know that there are costs involved in securing a tenancy.  If your tenant has provided first and last month’s rent, they will be eager to receive it back in full.   We advise that you use this letter than explains the predicament you are in as a landlord having a tenant backing out of a legally binding agreement they agreed to.

This Change Mind letter form will express the situation in a sympathetic but solution oriented manner.  It will stress that you – as landlord – will double your efforts to find a suitable replacement tenant to assume tenancy by roughly the same timeline.  However, you will deduct advertising, and relate [legitimate] costs for securing a new tenant from this tenants deposit.  That’s a fair and reasonable solution that will hopefully be acceptable to your tenant as well under the circumstances.  You can always adjust the wording of the letter to suit your specific needs.

Note: The laws in your area may address a situation where a tenant wishes to back out after committing to tenancy but before actually moving in or assuming tenancy.
